I'm not sure, but I think a software copyright will last 50 years after the product have been produced, or something like that. So by 2040 most C64 software will be free... Until then, it's illegal to download and/or copy C64 software.

No, they definitely aren't. Lemon has stopped carrying games because of a legal threat from a particular siftware company (dunno why he didn't either fight it, or just remove the games of that company, but there you go).

It's up to the author to state that they are freely distributable. If they don't then assume they are copyrighted.
The way I see it I own lots of the games I download or have done.
